Constitutional Courts in Focus

In the framework of the Ludovika Scholars Program, Dr Remzije Istrefi, Professor of Law at the University of Pristina and judge of the Constitutional Court of Kosovo, visited the Faculty of Public Governance and International Studies to give a public lecture and a workshop for interested students and colleagues. As an expert in constitutionalism, human rights, peacebuilding and transitional justice, Dr Istrefi's visit provided a unique opportunity to learn about the pressing legal and social issues facing a society emerging from conflict.

In her public lecture, Dr. Istrefi explored the broader role of constitutional courts in enforcing democratic principles and the rule of law, using Kosovo as a case study. She provided a vivid portrayal of the court's efforts to maintain legal accountability while questioning whether too much focus on legal punishment could impede long-term reconciliation efforts. Her lecture also highlighted the importance of community-driven reconciliation processes, emphasising that legal justice must often be complemented by cultural and societal healing.

The workshop focused on the specific challenges of rebuilding a constitutional framework in Kosovo following the conflict. Dr Istrefi detailed how the law has been used to promote reconciliation among Kosovo’s diverse ethnic groups, ensuring minority rights while balancing national unity. Key areas of discussion included the Constitutional Court’s role in protecting human rights through legal mechanisms, such as minority representation in government, language rights, and cultural protections. Dr. Istrefi also shared examples of constitutional disputes the court has faced, including land rights and tensions between national symbols and minority autonomy.

Dr. Istrefi's lectures were not only academically outstanding but also deeply practical. She won over audiences with her vast knowledge and directness, who praised her for her clear, engaging presentation and the vivid, real-life examples she shared from her experiences. During her visit, Professor Istrefi presented an important new perspective on the lasting effects of the Kosovo conflict, highlighting how the law continues to play a vital role in addressing historical grievances and promoting peace.
